1. Introduction

This Privacy Policy explains how LoadSmart OU (“we”, “us”, “our”) collects, uses, discloses, and protects personal data when you use our mobile and/or web app, Loadrex, https://loadrex.com (the “App”). The App enables drivers and owner-operators to share their location and ELD data as well as onboard, accept loads, track shipments, upload documents, and communicate.

You must agree to this policy to use the App. If you don’t consent, you may not access our services.


2. Information We Collect

a. Registration & Onboarding

  • PII: Name, address, phone number, email, date of birth, Social Security number, driver’s license, payroll & tax IDs
  • Employment History & Documentation: Past employer info, certifications, motor vehicle record, Form W‑9.

b. Device & Usage Data

  • Device type (make/model/OS), app version, IP address
  • App usage logs (feature use, timestamps, error reports)

c. Location Data

  • Real-time GPS location (foreground & background) while app is active
  • Location accuracy based on GPS/IP
  • Updates provided continuously during load operations, plus optional check-calls

d. Communications & Contacts

  • Phone number (for call routing), text/call metadata (timestamps); content not recorded without consent

e. Document Uploads

  • Driver-submitted PDFs/images (e.g. BOLs, bills, receipts, ELD logs, ID cards)

4. Location Tracking Policy

  • Active tracking begins when a load is accepted and ends at delivery.
  • Driver controls: You can pause/stop tracking; essential to app functionality.
  • We securely store location data only as necessary for operations, billing, safety, and compliance.

5. Data Sharing

We do not sell your personal data. We may share data with:

  • Service providers: e.g. hosting, SMS, document storage
  • Brokers & supply chain partners: for routing loads
  • Authorities: for legal requests, compliance, audits
  • Corporate affiliates: for operational purposes
  • Mergers: if business is transferred or sold

6. Data Retention

  • Onboarding & PII: retained as required by law (e.g. 7 years for payroll).
  • Location & shipment data: retained for defined periods (e.g. 3 months unless billing or safety issues extend retention).
  • Documents: retained until no longer needed for tax, audit, or dispute.
  • Secure deletion protocols apply after retention period.

7. Your Rights

  • Access / Correction: View or edit submitted info via the app or support.
  • Deletion: Request that we delete your PII, subject to legal obligations.
  • Opt-out: You may disable location tracking, understanding that it affects service eligibility.
  • Restrict / Object: Limit use of your data for marketing or non‑essential processing.
  • Disputes & Complaints: Contact us first; escalate to FTC or state authority if needed.

8. Children

Our App is for adults (18+). We do not knowingly collect data on minors.


9. Security

We use strong administrative, technical, and physical safeguards—encryption in transit and at rest, secure servers, internal policies, audits, and employee training—to protect your information.


10. Updates to This Policy

We may update this policy. Significant changes will be posted in-app with effective dates. Your continued use indicates acceptance.


11. California Privacy Rights (CCPA/CPRA Notice)
This section applies only to California residents and supplements the information in this Privacy Policy in accordance with the California Consumer Privacy Act (CCPA), as amended by the California Privacy Rights Act (CPRA).

a. Do Not Sell or Share My Personal Information
We do not sell or share your personal information, including sensitive personal information, as defined under California law. We do not engage in cross-context behavioral advertising.However, under the CCPA/CPRA, you still have the right to opt out of the sale or sharing of your personal information, should our practices ever change or be interpreted as such by regulators.To exercise this right at any time, you may:

We will honor your request in accordance with applicable law and confirm when your preferences have been updated.

b. Sensitive Personal Information Use
We collect and use sensitive personal information (e.g., Social Security number, driver’s license, geolocation data) only for permitted purposes, such as verifying identity, background checks, safety, and compliance. Under CPRA, you have the right to restrict our use of sensitive personal information to only what is necessary to deliver services. To exercise this right, contact us using the methods provided in Section 13.

c. Additional California Rights
If you are a California resident, you may also:
• Request to know what categories of personal information we collect, use, disclose, or retain
• Request access to specific pieces of personal information
• Request deletion or correction of your personal data
• Request to limit or restrict use of your sensitive personal data
• Appoint an authorized agent to act on your behalf

12. Cookies and Tracking Technologies
Although our App is primarily mobile-based, we may use certain tracking technologies, including but not limited to:
App Analytics SDKs (e.g., Firebase, Mixpanel): To monitor performance, user engagement, error reporting, and to improve functionality.
Push Notification Services: To deliver app alerts related to operations or account activity.

These technologies may collect information such as device identifiers, app usage data, and technical diagnostics. We do not use traditional web cookies, but similar technologies may function like cookies within the mobile app environment.

By using the App, you acknowledge and consent to the use of these tracking technologies for the purposes described above, including performance monitoring, app functionality, and communication.

You can opt out of certain tracking by disabling permissions within your device settings or contacting us at HR@foxcarriers.com for guidance.
